LH testified that the date went "very well" for the first five hours, leading to kissing and later, a visit to Kan's bedroom. She alleged that Kan engaged in several sexual acts against her will. When it was his turn to testify, Kan described LH as "very passionate" and "enthusiastic," claiming that she expressed enjoyment through sounds and body language. He characterized the sexual encounter as "consensual." Conflicting Accounts LH further testified that Kan, without verbal communication, pressed his forearm against her neck, instructing her to tap his elbow if she wanted him to let go. In contrast, Kan asserted that he used his hand—not his forearm—for what he called an "enhanced sexual experience," and that they had pre-established the tapping signal.

After their encounter, LH stayed over and, the next morning, they shared hugs and kisses before she left. She later told defense attorney Jim Lutz that she "hadn't taken any of it too seriously" at the time. It was only after consulting friends that LH decided to report the incident to the police.
